Abstract

This article analyzes the implementation of the anti-asylum policy in Tocantins, contrasting it with traditional psychiatric hospitalization models. Focusing on the state's 27 penal establishments and the 20 individuals with mental disorders in conflict with the law, the research investigates how Tocantins integrates anti-asylum policies in the face of structural challenges and stigmatization. The methodology includes a detailed documentary analysis and data collection from sources such as the Monitoring and Oversight Group of the State Prison and Socio-Educational System (GMF), the National Secretariat for Penal Policies, and the National Penal Information System. The study reveals that despite progress with the National Council of Justice Resolution No. 487 of February 15, 2023, critical barriers remain, including the lack of a Psychiatric Assessment Team (EAP). Implementing a humane and integrated approach is essential to ensure compliance with the rights provided for in the 1988 Federal Constitution and international human rights treaties, reaffirming the commitment to the dignity and social reintegration of individuals with mental disorders in conflict with the law.
