The Legal-Criminal Treatment of Psychopathy in Brazil: Normative Gaps, Limits of Security Measures, and Challenges to the Protection of Society and Human Rights.

This paper analyzes the legal and criminal treatment given in Brazil to individuals diagnosed with Antisocial Personality Disorder (APD) and psychopathic traits, highlighting the normative gaps and limitations of security measures in light of the tension between protecting society and guaranteeing fundamental rights. A qualitative approach is used, based on an interdisciplinary literature review and analysis of criminal legislation, forensic psychiatry, and recent criminological studies. The results indicate that the Brazilian legal system lacks adequate mechanisms for the ongoing management of the dangerousness associated with these individuals, especially after they have served their sentences, and that the available institutional structures do not address the clinical and criminological specificities of ASPD. It is concluded that it is necessary to formulate specialized public policies, more precise forensic protocols, and intervention models capable of integrating criminal justice and mental health in order to reconcile human rights with collective security.
