The Judge of Guarantees: Advances, Setbacks and Impacts on the Brazilian Judiciary System

This article analyzes the institution of the judge of guarantees, introduced into the Brazilian legal system by Law No. 13,964/2019 (Anti-Crime Package), focusing on its contributions to judicial impartiality and the challenges faced in its implementation. The separation between the functions of supervising the criminal investigation and adjudicating the merits was designed to strengthen the accusatorial system and safeguard the fundamental rights of defendants. However, the decisions of the Supreme Federal Court (STF) in Direct Actions of Unconstitutionality (ADIs) 6,298, 6,299, 6,300, and 6,305 have limited the scope of this institution, restricting its jurisdiction and postponing its implementation—generating criticism for undermining the impartiality originally proposed. This study also examines international models, such as those adopted in Germany, Italy, and Portugal, which inspired the juiz das garantias, and evaluates the structural obstacles within the Brazilian Judiciary, especially in single-judge districts. The study concludes that, despite normative advances, the effectiveness of the juiz das garantias depends on structural adjustments and political will to consolidate a more just criminal procedure aligned with the constitutional principles of the Democratic Rule of Law.
