Bioethics in Service of the Judiciary

Abstract

Bioethics, initially conceived as a discipline devoted to the study of ethical issues related to medicine and the life sciences, has evolved into an interdisciplinary field that now extends beyond the universe of health. Its investigative branch has stood out in the legal sphere by offering analytical parameters that assist courts in dealing with complex conflicts in which science, morality, and law are inseparably intertwined. The present study aims to understand how investigative bioethics can contribute to the performance of the Brazilian Judiciary, promoting decisions that are more humane, responsible, and coherent with constitutional principles. The research employed a bibliographic, qualitative methodology, grounded in scientific articles, reference books, and national jurisprudence. The results indicate that investigative bioethics plays an essential role in the interpretation of expert evidence, in the mediation of conflicting values, and in the reduction of judicial arbitrariness. It is concluded that its integration into the courts favors more balanced, reasoned, and legitimate decisions, consolidating the dialogue among science, ethics, and law.
